Terms of Service

Last updated: 29 September 2026

ParkMarket is a marketplace operated by Hengineering OÜ ("ParkMarket", "we", "us"), a company registered in Estonia, that lets people who own or control a parking space ("Hosts") list it for rent, and lets people who need parking ("Guests") find and book one. These Terms govern your use of the ParkMarket website and apply to everyone who creates an account, lists a space, or makes a booking.

By creating an account or using ParkMarket, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the service.

1. What ParkMarket is — and isn't

ParkMarket is a platform that connects Hosts and Guests. We are not a party to the parking arrangement itself: the contract for use of a space is between the Host and the Guest, not with ParkMarket. We don't own, inspect, or manage any listed space, and we don't guarantee a space's condition, legality, availability, or that it matches its listing.

A Host is responsible for having the legal right to offer their space for rent (ownership, a lease that permits subletting, or equivalent permission) and for the accuracy of their listing. A Guest is responsible for using a booked space only as agreed and for complying with any rules the Host has set out.

2. Accounts

You need an account to list a space or make a booking. You must provide accurate information (including your name, phone number, and address) and keep it up to date — a Host and Guest need to be able to reach and identify each other for a booking to actually work. You're responsible for activity under your account and for keeping your password secure.

You must be at least 18 years old to create an account.

3. Listings and bookings

Hosts set their own price, availability, and any access instructions or rules for their space. A booking request either needs the Host's confirmation, or is confirmed automatically if the Host has turned on "Instant Book" for that listing. A Guest and Host can message each other through ParkMarket to coordinate details like gate access.

Don't use the in-app messenger to exchange contact details or move the booking off-platform before it's made — messages containing phone numbers, emails, links, or names of other payment/contact apps are automatically blocked. This keeps both sides covered by the same record of what was agreed, and keeps the reviews and dispute history meaningful.

4. Fees

Listing a space on ParkMarket is free. ParkMarket charges a service fee of 12.5% on completed bookings, which a Host can choose to cover themselves or split evenly with the Guest (6.25% each) — see the /pricing page for the exact breakdown and worked examples. This fee structure can change; we'll post any change here and, where required, notify affected users in advance.

5. Payments

ParkMarket does not yet process payments on the platform. At this stage, a confirmed booking is an agreement between the Host and Guest to be settled directly between them, outside ParkMarket — ParkMarket does not hold, transmit, or guarantee any payment made in connection with a booking made today. This section will be updated, and users notified, once in-platform payment processing (through a licensed payment provider) goes live. When it does, ParkMarket will never itself store your raw card details — card entry will always go through that provider's own secure form.

6. Cancellations

A Guest can cancel a booking, and a Host can decline a pending request or cancel a confirmed one; either side can optionally leave a reason, which is shown to the other party and kept on the booking's record. ParkMarket doesn't currently enforce a cancellation policy (e.g. fees for a late cancellation) — that's between Host and Guest until a real payment/escrow system exists to enforce one automatically.

7. Reviews

After a booking's time has passed, either side can leave a rating and optional comment about the other. Reviews must be honest accounts of your own experience — don't post a review for a booking that didn't happen, and don't offer or accept anything in exchange for a review. We may remove a review that violates this or applicable law.

8. Prohibited use

Don't use ParkMarket to list a space you don't have the right to rent out, to discriminate against a Guest or Host on a protected basis, to harass another user, to post false or misleading information, to circumvent the platform's fees by taking a ParkMarket-sourced relationship off-platform, or to use the service for anything unlawful.

9. Liability

ParkMarket is provided on an "as is" basis. To the maximum extent permitted by law, ParkMarket is not liable for the condition of a listed space, a Host's or Guest's conduct, damage to a vehicle or property, or any dispute between a Host and a Guest — those are between the two of them, not ParkMarket. Where Estonian or EU consumer-protection law grants rights that can't be excluded, those rights aren't affected by this section.

10. Account suspension

We may suspend or close an account that violates these Terms, misuses the platform, or where we reasonably believe continuing to provide the service would create risk to other users. We'll generally tell you why, except where we're legally restricted from doing so.

11. Changes to these Terms

We may update these Terms as the platform evolves (for example, once real payments go live). We'll update the date at the top of this page when we do; continuing to use ParkMarket after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Estonia. Any dispute not resolved directly will be subject to the jurisdiction of the Estonian courts, without prejudice to any mandatory consumer-protection rights you have under the law of your own country of residence.
